Terms and conditions

1. Scope

These terms apply to all contracts for wedding websites between Surenthan Rasaratnam, Canton of Zurich (“we”) and the couple (“you”).

2. Services

We provide a wedding website for you at an address on tietheknot.ch and operate it during the term. You add the content yourselves; from the Premium package, we set up the website for you on request. The quote defines which features your website has (for example guestbook, photos, RSVPs).

3. Conclusion of contract

A request through the form is non-binding. The contract is concluded when you accept our quote by email.

4. Payment

The conditions as per the individual quote apply. Unless the quote says otherwise, payment is due within 30 days of the invoice.

5. Term and end

The website stays online for up to 12 months after the wedding date. No later than one month before the end, we notify you. On request, you receive an export of the content beforehand. When the term ends, we delete the website and all data, and backup copies no later than 30 days later.

6. Your obligations

• You only upload content for which you hold the necessary rights, and you make sure the same applies to content of your guests that you approve.
• You bear full responsibility for all content uploaded by you or your guests (photos, videos, music, texts). This applies in particular to copyrighted works such as music. The couple is liable for any legal violations caused by uploaded content.
• You inform your guests that their details are processed on your website and refer them to our privacy policy.
• You keep your login details secret and tell us about any misuse immediately.

7. Availability

We operate the websites with care but cannot guarantee uninterrupted availability. Where possible, we do not schedule maintenance in the week before your wedding.

8. Liability

We are liable for damage we cause intentionally or through gross negligence. Any further liability is excluded to the extent permitted by law. In any case, liability is limited to the amount you paid for the website.

9. Data protection

Our privacy policy applies. For your guests’ data, the data processing annex below applies in addition.

10. Changes

We notify you of changes to these terms by email. For ongoing contracts they only apply if you agree.

11. Governing law and jurisdiction

Swiss law applies. Place of jurisdiction is the Canton of Zurich. Mandatory places of jurisdiction for consumers remain reserved.

Annex: Data processing

1. Subject and duration: We process personal data of your guests on your behalf for as long as your website exists (section 5).
2. Nature and purpose: Storing and displaying guest lists, RSVPs and uploaded content so the website works. No use for our own purposes.
3. Types of data and data subjects: names, usernames, email addresses, RSVPs including details such as dietary needs, photos, videos, voice messages, texts. Data subjects are your guests and you.
4. Instructions: We process the data only according to your instructions, given through the website or by email.
5. Confidentiality: Only the operator has access to the data and is bound to confidentiality.
6. Technical and organisational measures: encrypted transmission (TLS), passwords stored only as hashes, separation of data between weddings, access limited to the operator, regular updates.
7. Sub-processors: Hetzner Online GmbH, Gunzenhausen, Germany (servers and email). We inform you before any change. You may object for good reason.
8. Assistance: We help you answer requests from guests about their rights and notify you of a data breach without undue delay.
9. Return and deletion: On request, you receive an export of the content before the term ends. Afterwards we delete all data (section 5).
